Overview

The Board of Zoning Adjustments sits as a quasi-judicial body to hear applications for variance(s) from the requirements of the Zoning Ordinance and/or the interpretation of the Ordinance by the Zoning Administrator. The Development Services staff administers applications to the Board. The applications are reviewed, and an analysis and recommendation are prepared for the Board. The application is then heard at a public hearing, when the Board will hear speakers and decide. All decisions are final. Any appeals from a Board of Zoning Adjustment decision are made to the Circuit Court (Appeals must be filed with the Circuit Court within 15 days of the hearing date).

Documents needed for the application include:

  1. A copy of the deed for the subject property as recorded in the county probate office. (The document should display the recording information placed on it by the Probate Court.)
  2. If the applicant is not the property owner, the owner must complete and submit an agent authorization form.
  3. Any drawings, maps, etc., which might help communicate the request.
